KudoTaps offers this website, including all information, software, products, and services available from this website or offered as part of or in conjunction with this website, to you, the user, conditioned upon your acceptance of all of the terms, conditions, policies, and notices stated here. KudoTaps reserves the right to make changes to these Terms and Conditions immediately by posting the changed Terms and Conditions in this location.

Your continued use of the website constitutes your agreement to all such terms, conditions, and notices, and any changes to the Terms and Conditions made by KudoTaps.

The term "KudoTaps" or "us" or "we" refers to the owner of the website. The term "you" refers to the user or viewer of our website.

Products & Services

KudoTaps provides NFC-enabled review stands, smart business cards, QR code solutions, and Smart Review Stand services to help businesses collect customer reviews and share contact information. Our products are designed to enhance customer engagement and simplify the review collection process.

All products come with our satisfaction guarantee. If you experience any issues with your KudoTaps product, please contact us and we will work to resolve the issue promptly.

Smart Review Stand Subscription

By purchasing or activating a Smart Review Stand, you agree to a recurring monthly subscription fee of $3.99 per month per location. This fee covers ongoing access to the Smart Review Stand service, including review routing, NFC functionality, QR code management, and dashboard analytics for each location.

The subscription will begin upon activation of the Smart Review Stand and will automatically renew each month until cancelled. You may cancel your Smart Review Stand subscription at any time by contacting us at tap@kudotaps.com or by calling (407) 543-1205. Upon cancellation, the service will remain active through the end of the current billing period. No partial-month refunds will be issued.

KudoTaps reserves the right to change the subscription pricing with 30 days' advance notice. Continued use of the Smart Review Stand service after a pricing change constitutes acceptance of the new pricing.

Payment & Billing

By providing a payment method during checkout, you authorize KudoTaps to charge the payment method on file for all purchases, recurring subscription fees, and any applicable taxes. Your payment information will be securely stored for processing future subscription charges and orders.

You are responsible for keeping your payment information up to date. If a recurring payment fails, KudoTaps reserves the right to suspend or deactivate the associated Smart Review Stand service until payment is successfully processed.

All fees are non-refundable except as expressly stated in our Returns & Refunds section below.

Returns & Refunds

We stand behind our products. If you are not satisfied with your purchase, you may return it within 30 days of delivery for a full refund. Products must be in original condition and packaging.

Custom or personalized products (such as custom-branded NFC cards or stands) are non-refundable once production has begun, unless there is a defect in the product.

Monthly subscription fees for Smart Review Stands are non-refundable. You may cancel at any time, but no refund will be issued for the current billing period.

Third-Party Services & Google Reviews Disclaimer

KudoTaps is not affiliated with, endorsed by, or sponsored by Google, Yelp, Facebook, TripAdvisor, or any other third-party review platform. Our products and services are designed to facilitate and simplify the process of directing customers to leave reviews on third-party platforms. However, KudoTaps does not control, manage, or have any influence over these platforms.

You expressly acknowledge and agree that:

  • KudoTaps is not responsible for any reviews that are removed, filtered, hidden, or otherwise affected by Google or any other third-party review platform.
  • KudoTaps is not responsible if Google or any other platform suspends, restricts, disables, penalizes, or terminates your business listing, account, or profile for any reason, including but not limited to alleged violations of the platform's terms of service, review policies, or community guidelines.
  • KudoTaps is not responsible for any changes to third-party platform algorithms, policies, review display methods, review filtering systems, or terms of service that may affect the visibility, quantity, or quality of your reviews.
  • KudoTaps is not responsible for any negative reviews, fake reviews, defamatory reviews, or any other user-generated content posted about your business on any platform.
  • KudoTaps is not responsible for any loss of business, revenue, customers, reputation, or any other damages arising from the use or inability to use third-party review platforms in connection with our products or services.
  • KudoTaps makes no guarantees regarding the number of reviews you will receive, the rating of reviews, the visibility of reviews, or any specific business outcome resulting from the use of our products or services.
  • You are solely responsible for ensuring that your use of KudoTaps products and services complies with the terms of service, review policies, and community guidelines of any third-party platform, including but not limited to Google, Yelp, Facebook, and TripAdvisor.

KudoTaps provides tools to facilitate review collection. The manner in which you use these tools, and any consequences arising from that use on third-party platforms, is entirely your responsibility.

NFC Smart Business Cards Disclaimer

KudoTaps NFC-enabled smart business cards are designed to share contact information and digital profiles via NFC technology. You acknowledge and agree that:

  • NFC functionality depends on the recipient's device supporting NFC technology. KudoTaps is not responsible if a recipient's device does not support or properly read NFC.
  • KudoTaps is not responsible for any inaccuracies in the contact information or content you choose to program into your smart business card.
  • You are solely responsible for all content, links, and information displayed through your smart business card and digital profile.
  • KudoTaps is not responsible for any third-party websites, apps, or services linked from your smart business card or digital profile.

QR Code Services Disclaimer

KudoTaps provides QR code generation and management services. You acknowledge and agree that:

  • KudoTaps is not responsible for the content of any destination URL or webpage that a QR code directs to.
  • QR code scanning depends on the user's device and camera capabilities. KudoTaps is not responsible if a QR code cannot be scanned by a particular device.
  • You are solely responsible for ensuring that the content linked through your QR codes complies with all applicable laws and regulations.

KUDOTAPS DOES NOT WARRANT THAT: (A) THE SERVICES WILL MEET YOUR REQUIREMENTS; (B) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; (D) ANY ERRORS IN THE SERVICES WILL BE CORRECTED; OR (E) THE SERVICES WILL RESULT IN ANY SPECIFIC NUMBER OF REVIEWS, BUSINESS OUTCOMES, OR INCREASE IN REVENUE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KUDOTAPS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF KUDOTAPS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL KUDOTAPS' TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE TOTAL AMOUNT PAID BY YOU TO KUDOTAPS DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

  • Any claim related to reviews solicited or received in connection with KudoTaps products, including but not limited to claims of fake reviews, incentivized reviews, or review manipulation
  • Any action taken by Google, Yelp, Facebook, TripAdvisor, or any other third-party platform against your account or listing as a result of, or in connection with, your use of KudoTaps products or services
  • Any claim arising from your Smart Review Stand subscription, including disputes with your customers

No Guarantee of Results

KudoTaps makes no representations, warranties, or guarantees regarding specific results from the use of our products or services. Results may vary based on numerous factors beyond our control, including but not limited to your industry, location, customer base, service quality, and third-party platform policies. Any testimonials, case studies, or examples of results achieved by other users are not a guarantee that you will achieve similar results.

Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Orange County, Florida, and you consent to the personal jurisdiction of such courts.

Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting KudoTaps at tap@kudotaps.com. If the dispute is not resolved within 30 days, either party may proceed with formal legal action.

Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect and enforceable.
